How Does Mediation Work?

What can I expect?

Online Mediation Protocol

Our mediation style is rooted in nonviolence and mutual respect. A mediator is not a judge and has no authority to impose a decision on any party. However, parties may request a judgment from a mediator willing to act in that capacity. The strength of such a judgment lies not in enforcement power but in its inherent wisdom and fairness. The goal of mediation is to craft solutions that are compelling due to their justice and balance. All mediation sessions are conducted online, ensuring accessibility and convenience for all parties involved.

Step One: Intake

  1. Understanding the Parties
  • The mediator meets with each party individually via an online platform to gather background information.
  • Parties are given digital forms to complete, detailing their concerns, interests, and goals.
  • The mediator listens actively, validates emotions, and ensures that each party feels heard and acknowledged.
  1. Establishing Guidelines
  • Parties agree to engage in good faith.
  • The mediator explains the process, emphasizing nonviolence and respect.
  • Confidentiality is maintained to foster open dialogue.

Step Two: Information Gathering & Analysis

  1. Collecting Perspectives
  • Each party presents their side without direct confrontation through online submissions and video conferencing.
  • The mediator identifies key issues and interests.
  1. Balancing Interests
  • AI tools may be used to assist in analyzing information and suggesting equitable solutions.
  • The mediator evaluates proposed resolutions to ensure they align with justice and fairness.

Step Three: Shuttle Mediation (Principled Mediation)

  1. Facilitating Communication
  • Parties do not engage in direct communication to avoid conflict.
  • The mediator moves between parties via private online sessions, relaying concerns and proposals.
  1. Ensuring Rights & Autonomy
  • The guiding principle is that no party's rights shall be violated.
  • Each party's autonomy and agency are respected throughout the process.

Step Four: Resolution & Agreement

  1. Crafting the Agreement
  • The mediator helps formulate a mutually acceptable resolution.
  • Agreements are documented digitally and reviewed for clarity and fairness.
  1. Finalizing the Process
  • Parties confirm their understanding and commitment.
  • If necessary, follow-up mechanisms can be established to ensure adherence.

This online mediation protocol ensures that disputes are resolved with justice, fairness, and respect for all parties involved. By maintaining principled mediation in a virtual setting, we create solutions that uphold individual rights while fostering cooperative resolutions.

Cost & Accessibility

I know what you are wondering: how much does it cost? Well, that all depends on you. We offer a discount for those who abide by the nonviolence rule, keeping their family matters out of the courts. To keep mediation accessible and affordable for the common working person, each party pays per hour an amount equal to what they earn in an hour at their own job. If either party escalates the matter into court, they will pay a prearranged penalty. What have we learned here? Stay out of court! Contact ACS.
