At ACS, we aim to reduce or avoid the many types of damage that can be done to wealth, children, and families exposed to conflict, especially the types of conflict that can end up in court. For example, when experiencing a divorce, families often spend upwards of tens of thousands of dollars in legal fees and private mediation, without much resolution. And more often than not, one or both parties goes away feeling abused, not only by their former spouse, but also by the system itself.
The mediation services provided by the courts often lack independence, and so they cannot function as truly neutral mediators. In true mediation, the parties retain their self determination and all of their rights. The mediator is truly neutral and does not make orders or recommendations to any court. The role of the mediator is to facilitate a conversation and good faith negotiation on the issues between the parties resulting in a 100% consensual settlement agreement. The parties are always the masters of their own bargain.
The mediator recognizes common patterns of coercion and manipulation, and steers the parties towards a more peaceful and respectful way of speaking and listening, by modeling this behavior him or herself. The parties are able to be fully heard, and their concerns are effectively communicated to the other party, something that the legal system cannot do. Our mediators employ a “shuttle” model of mediation, in which the parties do not speak directly to each other, but to the mediator, who “shuttles” back and forth between them.
We provide this service at a fraction of the cost usually charged by private mediators, and in many cases, our services are completely free.
